No Win No Fee Claims

A personal injury resulting from a non-fault accident can bring life-changing effects. Medical bills pile up. You might miss work. The last thing you want to worry about is paying huge legal fees upfront. So, please find some reassurance in the first instance, that RU1NJURED’s panel of personal injury lawyers totally offer a No Win No Fee payment arrangement.

Understanding The No Win No Fee Concept

No Win No Fee is a Conditional Fee Agreement (CFA) between the claimant and their solicitors.  A No Win No Fee agreement simply means, you only pay your personal injury solicitor’s fee, if you secure a payout. You will not owe any legal fee to your No Win No Fee solicitor, if your personal injury claim is not successful. Simple as that.

Basically, in a No Win No Fee claim, your personal injury lawyer shares the risk with you. They believe in your case enough to work without getting paid unless you succeed.

How Does It Work?

Before taking your case, your solicitor checks if you have a reasonable chance of winning. They look at who caused the accident, how you were hurt and if the other person should pay for your losses along with how you should go about preparing a case.

Most accident claim solicitors only take cases with at least a 65% chance of success. It is actually a good thing. As it might also save you time and money in pursuing a weak personal injury claim. If you win, your solicitor takes their normal fees plus a “success fee” from your compensation. If your claim is not successful, you do not pay your No Win No Fee solicitor for their time.

What Happens When You Win?

When you win your personal injury claim, your solicitor gets paid in two parts:

  • Basic fees: Their normal charges for the work carried out.
  • Success fee: An extra payment for taking the risk.

According to the Conditional Fee Agreements Order 2013, accident claim solicitors can take up to 25% of your compensation as a success fee. For instance, if you receive a £20,000.00 award, the personal injury solicitors share cannot be more than £5,000.00. Many firms do charge the full 25%. You should expect and explore this when planning to initiate your personal injury claim.

Understanding the Costs

Even if you utilise the No Win No Fee option, some costs may still need to be paid. Here are some of them:

  • You must still pay case expenses, known as disbursements. This includes things like court fees and expert medical report expenses. Your solicitor usually pays these upfront and expects you to repay them from your compensation. This information can be found in the conditions of the (CFA), No Win No Fee agreement.
  • You may need to pay an insurance premium if you get After-the-Event (ATE) insurance. It is a safety net that protects you from paying the other side’s legal fees if your claim does not succeed.  This is an element that your personal injury solicitor will explore with you a little later along your claims journey.

  • If the court finds you have been dishonest about your claim.
  • If you reject a fair offer and later lose at court.

Choosing the Right Solicitor

Not all accident claim solicitors are the same. Here is what to look for:

  • Check whether they are regulated by the Solicitors Regulation Authority (SRA). Avoid anyone who cold-calls you or uses high-pressure tactics.
  • Ask them to explain all costs clearly. They should tell you exactly what percentage they will take if you win. They must also explain the costs if somehow you lose your case.

Moreover, get everything in writing. The law requires your CFA to be written clearly so you understand it.
