Employer's responsibility & Duty of Care

An employer holds a legal obligation to put and keep in place various measures in accordance to health and safety regulations, to keep their employees safe from harm, as well as maintaining a high standard of care, in regards to the safety and well-being of its employees.

Identifying Negligence

It will always remain the duty of the Claimant or the injured person to establish negligence and most workplace accidents, including accident at work claims, can be reverse investigated and traced back to negligence.   It is quite common in these circumstances that an employer may have breached their duty of care upon you.  However, you must be able to show the following:

  • You were an employee.
  • That your employer has breached their duty of care upon you
  • This breach directly caused your injury.

The above is simply a guideline to help distinguish that your employers caused your injury.

After an accident what should you do?

It is important to note that after an accident you will be in shock.  You will find it difficult to think clearly due to the stress.  We have presented some steps below that you may wish to consider:

1. Get medical help

It is important to get the medical assistance you need from your work colleagues and designated first aider at your workplace, who should properly examine and call an ambulance if there is cause for concern.  In any event you should consider being examined and treated by a medical professional where possible and required.

2. Notify your colleagues

It is important you report your accident to a designated person and notify your colleagues that an accident has occurred and to alert them of any dangers.

3. Make a note of what happened

At your earliest opportunity jot down what happened. In most cases an accident log book is completed, be sure that you review what is recorded and obtain a copy.

4. Speak to witnesses

If any of your colleagues had witnessed the accident be sure to obtain their full names and contact numbers.  Where possible ask them to write down what happened or discuss these matters by text message in order to keep a record.

5. Take photos

It is important to periodically take and keep photos of your own injuries.  You can try to obtain pictures of the accident scene as this will help you later on.

6. Report the accident to your employer

Just as much as your employer has a duty of care for you, you also are responsible to report any accidents and injuries to your employer.  Please ensure you have reported your accident to your employer.

7. Ensure your accident is recorded

Please be sure you have officially recorded your accident in to your employer’s accident book and retained a copy of the same for your own records.  In rare circumstances an employer may refuse to record your accident, in such cases revert to writing to them by email or post to retain evidence that you certainly attempted to report it.

8. Record your symptoms

It is always difficult to remember all that you are feeling and experiencing, bruises fade away and sometimes trauma makes you rather forget than retain a memory of the causing effect.  However, it is important to keep a daily diary recording your symptoms and taking images of your injury, especially when dealing with accident at work claims.

It is also important to stay in touch with your GP and attend any follow up medical treatment with hospital or medical advice.  If you have had needed help at home with your choirs keep a note of the amount of time your loved have spent upon you.

There will come a point in your claim where this information will help show the impact the accident at work has had on your health and wellbeing.

9. Log your financial losses

Medical treatments and rehabilitation can be costly, this also includes medication and other losses such as earnings, parking tickets for hospital visits, medicine.  In some serious cases due disability, changes in your home.  This is why it is important you keep a log of any expenses or losses you are incurring.
